Brand name and registered business name

Alalaho is the public facing brand name of “Jennifer Tessler E.I.”, in this text the name “Alalaho” refers to the legal entity “Jennifer Tessler E.I.”, trading as Alalaho, as well as its representatives.

 

Onboarding call

After reserving your spot and paying your deposit, you will be invited to schedule an onboarding call. We aim for all participants to have had a call with one of our staff prior to confirming their reservation. This call will take place via Zoom or Google Meet and will not be recorded unless specifically requested and with your permission. The staff member will take notes in our booking system during the call for later recollection, or to share with relevant staff members if needed.

 

No-shows on Scheduled Onboarding calls

We understand that plans can change, but to ensure the smooth operation of our retreats, it’s essential to honour your scheduled onboarding call.

If you do not attend your onboarding call without prior notice, your reservation will be automatically canceled, your room will be released back on our website, and your deposit will be non-refundable.

The deposit can be transferred to another booking if you make a new reservation within one month of the no-show.

If you need to reschedule, please do so in advance using the Reschedule link in your confirmation email or contact us directly via email before your scheduled call.

If you miss your second scheduled onboarding call, the deposit will be forfeited.

Application

In order to join an Alalaho retreat and prior to the onboarding call, you are required to fill out an application form and to provide information about yourself including your first and last name, email address, and other personal information. You agree that any information that you provide to Alalaho, will always be correct, accurate, and current. You agree to not impersonate someone else or to provide any information or an email address that is not your own.

 

Refusal of Service

The services are offered subject to our acceptance of your application and payment. We reserve the right to refuse to service any person or entity, without the obligation to provide an explanation. We may at any time change or discontinue any aspect or feature of our services, subject to fulfilling our previous responsibilities to you based on acceptance of your payment.

 

Payment

You acknowledge that Alalaho reserves the right to offer sales or discounts on the full retail price of their products and services without compensation if you paid a higher price.

Payment plans must be paid in full before attending the retreat. If a payment is not made 2 weeks past the due date, Alalaho reserves the right to cancel the reservation linked to the payment plan and the monies paid are not eligible for a refund. 

 

Refund and Cancellation

Upon booking a retreat, your payment incorporates a 300€ non-refundable deposit.

Should your application be declined due to health concerns or at our discretion, you are eligible for a partial refund—this being the total amount paid minus a 20€ administrative fee.

If for whatever reasons, you chose to withdraw your application and cancel your reservation, the deposit will not be refunded.

If you can no longer attend the retreat you’ve booked, we provide the following options:

Up to 6 weeks before the retreat, you are entitled to a full refund, minus the non-refundable deposit.
Alternatively, you may transfer the full value of your payment towards a future retreat, without incurring any additional charges.

Between 6 to 3 weeks prior to the retreat, you are eligible for a refund of 50% of the total cost, excluding the non-refundable deposit.

Cancellations made within 21 days of the retreat start date are not eligible for a refund. The proximity to the event significantly reduces our ability to fill the vacated spot, necessitating this policy.

 

COVID Policy

We comply with the national Covid regulations of the country where the retreat is hosted, be it Spain or Holland. Should any discrepancy arise between our policy and the local Covid regulations, the national regulations of the retreat location will prevail.

Currently there are no restrictions for an event such as ours. As of 21 March 2022, our policy is as follows:

  • Please ensure you are in good health before traveling to the retreat. If you exhibit any symptoms of illness, we kindly ask that you prioritise your well-being and public health by staying home.

  • As an additional safety precaution please remain as isolated as possible in the days leading up to the retreat to avoid infection and use this time as an opportunity for deeper preparation and personal inquiry time for the retreat.

  • For those traveling from abroad, please ensure you meet the entry requirements of the host country. Unfortunately, our retreat centers cannot accommodate quarantine stays, so any necessary self-quarantine due to travel must be arranged independently prior to the retreat.

  • To ensure the safety of all participants, we require a negative Covid-19 rapid test result from each attendee on the first day of the retreat, before joining us at the venue.

Our Covid policy is subject to change in response to new information, ethical considerations, or changes in national regulations of the host country. We will promptly communicate any adjustments to ensure the health and safety of all participants.

COVID-19 related cancellations:

Retreat organisations like us have been hanging by a thread to survive during Covid, so we have had to put in a cancellation policy that offers us some protection to weather any potential additional future storms. We ask for your understanding.

  • If Alalaho has to cancel your retreat due to COVID-19 health and safety or travel restrictions, we will store your full paid amount as credit towards a future retreat. This credit will not expire. 
  • If you are no longer able to attend due to COVID-19 health, safety or government travel restrictions, and notify us at least 21 days in advance, we will store your full paid amount as credit towards a future retreat. This credit will not expire. We ask that you provide documentation of your positive test result or country’s travel restrictions.
  • If you have to cancel within 21 days of your retreat for Covid-related reasons, we will retain a cancelation fee of 750€ additional to the 300€ deposit to cover some of the costs of your retreat place. We will refund you the remaining amount or you can use it as credit towards a future retreat. We do ask that you provide documentation of your positive test result or country’s travel restrictions.

If you are forced to cancel your place on a retreat, it is your obligation to notify us as soon as possible via hello@alalaho.org.

 

Force Majeure Event

No Party shall be liable or responsible to the other Party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make previously owed payments to the other Party hereunder) when and to the extent such failure or delay is caused by or results from acts beyond the impacted Party’s reasonable control, including, without limitation, the following force majeure events that frustrates the purpose of this Agreement: (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; (i) epidemic, pandemic or similar influenza or bacterial infection; (j) emergency state; (k) shortage of adequate medical supplies and equipment; (l) shortage of power or transportation facilities; and (m) other similar events beyond the reasonable control of the Impacted Party not mentioned here.



Retreat Cancelation

In the unlikely event that Alalaho has to cancel a retreat, you may be offered to change your booking to another similar retreat of your choice, or alternatively, for your retreat fee to be stored as credit for a future retreat. You may also be offered travel compensation equal to the costs of rebooking your travel to another retreat, up to a maximum of 200€.



Changed Terms

We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by the posting of the new Terms and Conditions on our website www.alalaho.org. Any use of the website or our services after being notified means you accept these amendments. We reserve the right to update any portion of our website and services, including these Terms and Conditions, at any time. We will post the most recent version to the website and list the effective date on this page.

 

Limitation of Liability

You agree that under no circumstances shall we be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the website or our services. additionally, Alalaho is not liable for damages in connection with (i) any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus, or line or system failure; (ii) loss of revenue, anticipated profits, business, savings, goodwill or data; and (iii) third party theft of, destruction of, unauthorised access to, alteration of, or use of your information or property, regardless of our negligence, gross negligence, failure of an essential purpose and whether such liability arises in negligence, contract, tort, or any other theory of legal liability. the foregoing applies even if Alalaho has been advised of the possibility of or could have foreseen the damages. in those jurisdictions that do not allow the exclusion or limitation of liability for the damages, our liability is limited to the fullest possible extent permitted by law. In no event shall Alalaho cumulative liability to you exceed the total purchase price of the services you have purchased from Alalaho, and if no purchase has been made by you, Alalaho cumulative liability to you shall not exceed €100.

 

Third-Party Resources

The website and the emails sent by Alalaho may contain links to third-party websites and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or policies of third-party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with Alalaho. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

 

Disputes Resolution

If you have any concern or dispute about the service, You agree to first try to resolve the dispute informally by contacting Alalaho.

 

Indemnification

You indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third-party claims and causes of action, including, without limitation, attorney’s fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of the website or services. You shall provide to us such assistance, without charge, as we may request in connection with any such defence, including, without limitation, providing to us such information, documents, records, and reasonable access to you, as we deem necessary. You shall not settle any third-party claim or waive any defence without our prior written consent.

 

Notices

All notices, requests, demands, and other communications under these Terms and Conditions shall be in writing and properly addressed as follows:

Severability

If any provision of these terms and conditions is or becomes invalid, the validity of the rest of the contract shall not be thereby affected. In this event, the parties commit to coming to an effective agreement that corresponds as closely as possible to the intended economic result of the invalid provision.
